Terms of Service
Terms of Service governing the provision of digital services by Jakkallas Digital to clients in South Africa.
1. Agreement
These Terms of Service ("Terms") govern the provision of services by Jakkallas Co (Pty) Ltd trading as Jakkallas Digital ("Jakkallas Digital", "we", "us") to clients ("you", "Client") in South Africa.
2. Services
Jakkallas Digital provides digital services including:
- Website design and development
- SEO and local search optimisation
- Google Business Profile optimisation
- Hosting and maintenance
- Lead generation systems
- AI chatbots and automation
- CRM integration
- Digital marketing support
3. Quotes and Proposals
Services are provided based on approved proposals, statements of work, or written agreements. Pricing, scope, and deliverables will be specified in writing before work commences.
4. Deposits and Payment
A deposit may be required before project commencement. Unless otherwise agreed in writing:
- Deposits are non-refundable once work has commenced
- Invoices are payable within 7 days unless otherwise stated
- Late payments may result in project suspension
- Monthly retainers are billed in advance
5. Client Responsibilities
You agree to:
- Provide accurate information, content, and feedback in a timely manner
- Ensure you have rights to all content and materials supplied
- Appoint an authorised contact for approvals and communications
- Review deliverables and provide feedback within agreed timeframes
6. Project Timelines
Timelines depend on scope, client responsiveness, and third-party dependencies. Delays caused by late feedback, content, or approvals may extend delivery dates.
7. Revisions
Reasonable revisions are included as specified in your proposal. Additional revisions or scope changes may incur extra fees.
8. Content Responsibility
You are responsible for the accuracy, legality, and appropriateness of content you provide or approve for publication. Jakkallas Digital may assist with drafting but does not guarantee factual accuracy of client-supplied content.
9. Third-Party Tools
Services may involve third-party platforms (hosting, analytics, CRM, payment gateways, AI tools). Their terms and availability apply. We are not responsible for third-party outages or policy changes.
10. Domain Registration
Domains may be registered in the Client's name where agreed. You are responsible for renewal fees unless covered by a maintenance plan.
11. Hosting Limitations
Hosting is provided on a shared or managed basis subject to fair use policies. Excessive resource usage may require plan upgrades.
12. AI Chatbot Services
AI chatbots are configured based on approved content and workflows. You are responsible for reviewing chatbot responses and ensuring compliance with applicable laws. See our AI Usage Disclosure.
13. Intellectual Property
Upon full payment, you receive rights to custom deliverables as specified in your agreement. Jakkallas Digital retains rights to pre-existing tools, frameworks, and methodologies. We may showcase completed work in our portfolio unless otherwise agreed in writing.
14. Cancellations and Refunds
Cancellations must be submitted in writing. Work completed to date and non-recoverable costs are payable. Refunds are at our discretion except where required by law or expressly agreed.
15. Limitation of Liability
To the fullest extent permitted by South African law, Jakkallas Digital is not liable for indirect, consequential, or special damages. Our total liability is limited to fees paid for the specific service giving rise to the claim, except where liability cannot be limited by law.
16. Service Availability
We aim for high availability but do not guarantee uninterrupted website or service availability. Maintenance windows and third-party outages may occur.
17. Support Boundaries
Support is provided as defined in your package or care plan. Support does not include unlimited custom development unless expressly included.
18. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Disputes shall be subject to the jurisdiction of South African courts.
